This is the last Will and Testament of me Alfred
John Aslatt of The Town and County of the Town of Southampton
Coach Builder made this twenty fifth day of January one thousand eight
hundred and sixty seven I Give devise and bequeath all my real and
personal estate whatsoever and wheresoever and which I shall die possessed
of or entitled to (except estates vested in me as Trustee or Mortgagee) unto
my wife Eliza Aslatt William Furber Auctioneer and Richard Seward
Pearce both of the Town and County of the Town of Southampton their
heirs executors administrators and assigns respectively Upon trust that the
said Eliza Aslatt William Furber and Richard Seward Pearce or the
survivor of them or the heirs executors or administrators of such survivor
shall in their her of his discretion sell call in and convert into money
the same or such part thereof as shall not consist of money and shall
with and out of the money produced by such sale calling in and conversion
and with and out of such part of my personal Estate as shall consist of
money pay my just debts funeral and testamentary expenses and at the
direction of the said Eliza Aslatt William Furber and Richard Seward
Pearce or the survivors of them or the executors or administrators of such
survivor (hereinafter called my Trustees or Trustee) invest the residue of
the said monies in the names or name of my Trustees or Trustee in
or upon any of the Parliamentary Stocks or public funds or Government
securities of the United Kingdom upon Mortgage of any messuages
lands or hereditaments and shall or may from time to time at such
discretion as aforesaid To vary the said Investments into or for others
of the same or a like nature and shall stand possessed of the said
residuary trust money and the stocks funds and securities in or upon
which the same shall from time to time be invested (hereinafter called
the residuary trust fund) Upon the trusts following (that is to say)
Upon trust to pay to or permit my said wife to receive the income thereof
so long as she shall continue Widow and from and after her decease
or marriage again whichever shall first happen then as well the capital
as the future income thereof In trust for my Children who being a
son or sons shall attain the age of twenty one years or being a
daughter or daughters shall attain that age or marry to be divided
between them in equal shares but if there shall be only one such Child
the whole to be In trust for that one child Provided always and

I declare that my Trustees or Trustee shall retain the share or
shares to which any daughter or daughters of mine shall become entitled
of and in the residuary trust fund Upon the trusts following (that is to say)
Upon trust to pay the income of the share of each such daughter to the
same Daughter during her life and so that if and while she shall be
under Coverture the same shall be for her separate use and she shall not
have power to dispose of the same in the way of anticipation and from
and after the decease of such Daughter In trust for the children of such
daughter who being male shall attain the age of twenty one years or
being female shall attain that age or marry in equal shares and if there
shall be only one such child the whole to be in trust for that one child
and in case there shall be no Child of such daughter who being male shall
attain the age of twenty one years or being female shall attain that age
or marry then Upon such trusts and in such manner as such daughter
by any Deed or Deeds with or without power of revocation and new
appointment or by her last Will or any Codicil thereto and whether she
be under coverture or not shall appoint and in default of such appointing
and so far as any appointment shall not extend In trust for
my other children in equal shares and so that the share or shares
accruing to each or any daughter of mine under this trust shall be
subject to the trusts hereby declared concerning the original share of the
same daughter under this my Will Provided always and I hereby declare
that if any child of mine shall die in my lifetime leaving a child or
children the child or children of him or her so dying as aforesaid who
being male shall attain the age of twenty one years or being female shall
attain that age or marry shall take (and if more than one equally between
them) the share to which his her or their parent would have been
entitled of and in the residuary trust funds if such parent had
survived me and attained the age of twenty one years including any
share or shares which could have accrued to such parent under the
trust and provision in that behalf hereinbefore contained And I empower
my Trustees or Trustee to apply the whole or such part as they or he
shall think fit of the income of the share to the principal or income
whereof any Son or Grandson of mine being an infant or any daughter
or Granddaughter of mine being an infant and unmarried would for the
time being be entitled to possession under this my Will if he or she

were of full age for or towards his or her maintenance and
education with liberty to pay the same to the Guardian or any of the
Guardians of such infant for the purpose aforesaid without seeing to the
application thereof and my Trustees or Trustee may exercise this power
without any regard to the ability of the father of any such infant to pay
for or contribute towards his or her maintenance or education And I direct
that my said Trustees or Trustee shall invest the surplus (if any)
of such income and the resulting income thereof in or upon any such
stocks funds or securities as aforesaid so as to accumulate at compound
interest with liberty from time to time to vary the said investments
into or for other of the same or a like nature and shall stand possessed
of the said accumulations upon the trusts hereby declared concerning the
share from which the same shall have proceeded with liberty
nevertheless for my Trustees or Trustee from time to time to resort to the
accumulations of any preceding year or years and to apply the same
for or towards the maintenance or education of any infant who if he or she
were of full age would for the time being be entitled to the said accumulations
or the income thereof And I empower my Trustees or Trustee at any time
or times to raise any part or parts not exceeding altogether one third of
the vested or expectant share of any child or grandchild of mine under
the trusts of this my Will and either to pay the monies to be so raised
as aforesaid to such a child or grandchild or otherwise to apply the same
for his or her advancement preferment or benefit as my said Trustees or
Trustee shall think fit but so that no such monies shall be raised
and applied as aforesaid during the existence of any prior interest or
interests therein under this my Will without the written consent of
the person or persons having such prior interest or interests which
consent in the case of a feme covert shall be effective notwithstanding
coverture And I declare that my property hereby directed or authorized
to be sold may be sold either together or in parcels and either by public
auction or private contract and either with or without any special or
other conditions or stipulations relative to title or otherwise and the
Trustees or Trustee making such sale may buy in any property put
up for sale by Auction or any part thereof and may rescind or vary any
contract for sale and may resell the property so bought in or the contract
for the sale whereof shall have been so rescinded as aforesaid without being

answerable for any less or diminution in price and may execute
assurances give effectual receipts for the purchase moneys and do all acts
and things for completing any such sale which they or he shall think
proper And I declare that my Trustees or Trustee may postpone the sale
and conversion of my real and personal Estate or any part thereof
for so long as they may think fit And that notwithstanding
that the property the sale or conversions whereof shall be so postponed
maybe of leasehold tenures or may be otherwise of a perishable or
wearing out nature and if any part of my Estate shall be of a
reversionary nature the same shall not be sold or converted into money
until it falls into possession unless my Trustees or Trustee shall think
it probable that a loss will arise to my Estate by postponing the sale
and conversion thereof And I declare that the rents profits and income
to accrue from and after my decease of and from such part of my
real and personal estate as shall for the time being remain unsold and
unconverted shall after payment thereout of all incidental expenses and
outgoings be paid and applied to the person or persons and in the manner
to whom and in which the income of the monies produced by such sale
and conversion would for the time being be payable or applicable under
this my Will if such sale and conversion had been actually made
And I empower my Trustees or Trustee from time to time to let any
hereditaments for the time being remaining unsold either from year to
year or for any term of years at such rent and subject to such covenants
as they or he may think fit And I hereby declare that if the Trustees hereby
appointed or either of them shall die in my lifetime or if they or either of
them or any future Trustee or Trustees of this my Will shall die or
desire to retire from or refuse or become incapable to act in the trusts of
this my Will before the same shall be fully performed then and in
every such case it shall be lawful for the then continuing Trustees or Trustee
for the time being of this my Will or if there shall be no continuing
Trustee then for the retiring or refusing Trustees or Trustee or the acting
executors or administrators or the executor or administrator of the last acting
Trustee to appoint any other person or persons to be a Trustee or Trustees
in the place of the Trustee or Trustees so dying or desiring to retire or
refusing or becoming incapable to act as aforesaid with liberty upon
any such appointment to increase or diminish the original number of
Trustees and upon every such appointment the trust premises shall be
so conveyed and transferred that the same may become vested in the
new Trustee or Trustees either jointly with the continuing Trustee or
Trustees or solely as the case may require and every such new Trustee
(as well before as after the trust premises shall have become vested in
him) shall have all the powers and authorities of the Trustee in whose
place he shall be substituted I Devise and Bequeath all Estates vested
in me as Trustee or Mortgagee unto the said Eliza Aslatt William Furber
and Richard Seward Pearce their heirs executors and administrators
subject to the trusts and equities affecting the same respectively but so
that the money secured by any such mortgages shall form part of my
personal Estate I appoint the said Eliza Aslatt William Furber and
Richard Seward Pearce to be executrix Trustees and Executors of this my
Will hereby revoking all former and other Wills by me at any time
heretofore made In Witness whereof I the said Alfred John Aslatt the
Testator have to this my last Will and Testament written on five sheets
of paper set my hand the day and year first before written

The Testator Alfred John Aslatt was late of 34 Above Bar
